- Samuel Alito's Voting Rights Act ruling cited misleading DoJ data on voter turnout — Justice Samuel Alito's majority opinion gutting Section 2 of the Voting Rights Act relied on voter turnout data from a Department of Justice friend-of-the-court brief that used a non-standard, misleading methodology. The DoJ calculated Black and white voter turnout as a proportion of total population over 18, including non-citizens and ineligible voters, rather than the standard citizen voting age population measure. When recalculated using standard methodology, Black voter turnout in Louisiana exceeded white turnout in only one of five recent elections, not two as Alito claimed. Experts identified the approach as deliberately manipulative.
